Tack On Pro Terms

Effective date: October 30, 2026. Version: pro-v5.

These Tack On Pro Terms (“Pro Terms”) are an agreement between Tack On LLC (“Tack On,” “we”) and the business that registers for Tack On Pro (“you,” the “Business”), and they bind every person the Business adds to its account. The Lead Refund Policy, the stored-card terms you accept when you save a card (or confirm again for a saved card when they change), the Terms of Service and the Privacy Policy are part of these Pro Terms. The person accepting them confirms they are authorized to bind the Business. You accept these Pro Terms in the app; we keep a record of the version you accepted and when.

Section 17 explains how disputes between the Business and Tack On are handled. There is no arbitration requirement: either side can go to court, and these Pro Terms don’t waive jury trials or class actions. Nothing here limits rights the law doesn’t let you waive, including under the Texas Deceptive Trade Practices Act.

1. What you are buying

  • A lead is the chance to contact one homeowner about one job they asked for through Tack On and picked you for. A lead is an introduction. It is not a booked job, an appointment or a promise that the homeowner will hire you. We don’t claim anything about how soon a homeowner intends to hire, how many leads you will receive, or how many turn into work.
  • What the lead fee pays for. When the homeowner picks you and the charge succeeds, you receive an exclusive introduction the homeowner authorized by picking you: the protected job and contact details they gave us (first name, phone number, full address, access notes, the full job description and how they want to be contacted), and an in-app message thread with the homeowner for that job. Before the pick you see only the limited preview described in section 4. Photos the homeowner added are not shared with you at this time.
  • We show each lead as the homeowner described it. What we confirm about a request: the homeowner’s mobile number (by one-time code), that the address is a home in Texas (placed by our mapping provider), the type of home as the homeowner told us, and the hazard answers as the homeowner gave them. We don’t verify anything else about homeowners, and you should confirm the details with them.
  • Joining is free. There is no subscription, no monthly minimum and no commission on your jobs.

2. Who can join (eligibility)

To take leads, the Business and the people it sends must meet these requirements and keep meeting them:

  • Plumbing: a plumbing company with a Responsible Master Plumber on TSBPE records (a sole master plumber registers as one), and each plumber sent holds an active TSBPE license.
  • Electrical: a Texas Electrical Contractor license (TECL) from TDLR with its master of record confirmed, and each electrician sent holds an active TDLR license.
  • Heating and air conditioning: a TDLR Air Conditioning and Refrigeration Contractor license, general liability insurance that we have confirmed through a method we accept (your insurer, your agent, or state records; a certificate you upload is not enough on its own), and each technician is a TDLR Registered or Certified Technician working under that license.
  • Every person who takes or performs leads passes an identity check with our verification provider (a government ID and a live selfie). We keep only the outcome: whether the check passed, that the person is 18 or over, and whether the name matches the license. The person named on the company license must be on the account and pass the same check.
  • A saved payment card accepted by the Business owner under the stored-card terms (section 6).

We check eligibility against state records before you can take leads and re-check it regularly, at least every 36 hours while you’re active. If a license lapses, a check goes stale, insurance can’t be confirmed, or we place a fraud hold, you stop receiving new leads for the affected trade until it is resolved; leads you already hold stay open so homeowners aren’t stranded. An apprentice can never be the only person sent to a job. We warn you 30, 7 and 1 days before a license or policy we rely on expires.

3. Your team

  • The account owner invites team members with single-use codes, decides which technicians may take leads, may limit how many leads each technician is picked for per day and per week, and may grant a dispatcher the right to show interest for named technicians. The Business is responsible for everything done under its account by anyone it added, and for removing people who leave.
  • When an owner or dispatcher shows interest in a lead, they name the technician who will do the work; that technician must have received the lead and be eligible for it. The Business must not send anyone who isn’t verified on its Tack On roster.
  • A technician’s “Not for me” on a lead is final for that lead: nobody at the Business can show interest for them on it. The lead stays open to other Pros. A Business can have one live interest per lead, whoever shows it.
  • A technician who works for more than one Business takes leads for one Business at a time and chooses which in the app. The Business whose card pays is the Business that holds the lead.

4. How leads are offered, and how homeowners pick

  • Leads are offered at the same time to eligible Pros within 30 miles of the job, and again to Pros who haven’t responded. A Pro taps “I’m interested”; that is free. The homeowner sees up to three interested Pros, first to respond first, each with the service call fee, whether it is waived if hired, a distance band, the licenses we checked (type, issuing agency and whose license it is) and when we checked, the month the ID was verified, the year the Pro first appears on state license records, and the Business’s self-declared start year marked “from the pro”. The homeowner doesn’t see your name or the Business name until they pick you. Our server decides the pick, and a lead is never sold twice.
  • Interest closes about 10 minutes after an urgent request opens, about 30 minutes after a same-day request, and about 12 hours after a scheduled request (or 24 hours before its window if sooner). An interest lasts 30 minutes for urgent jobs and until the homeowner’s pick deadline for same-day and scheduled jobs; you can withdraw it for free until you are picked. The homeowner’s pick deadline is shown to them; if nobody is picked, nobody is charged.
  • You receive urgent and same-day offers only while you have set yourself as available in the app, and scheduled offers only when your availability or a declared working area covers the window. Don’t handle offers while driving; use “Pause alerts”.
  • The lead price is shown before you show interest and is fixed for that lead. The standard price is $20.00 in total (US dollars) per completed introduction: any Texas sales and use tax that applies is included in that price, never added on top. The price on a lead never changes after you have been shown it; if the standard price ever changes, the new price applies only to leads shown to you after the change, and you always see it on the lead before you show interest.
  • Showing interest is a binding offer to buy the lead at the shown price if the homeowner picks you before your interest lapses or you withdraw it.
  • Picking can be temporarily unavailable, for example while we have paused charges. Then no Pro is picked, nothing is charged, nothing is shared, and your interest stays live: its time limit stops while picking is unavailable and resumes with the time it had left, unless you withdraw it. The homeowner is told to check back. If a pick had already started when picking became unavailable, it is released without a charge and your interest is live again, so the homeowner can pick again once picking is back.

5. Your service call fee

  • Your service call fee is your own price for coming out, set per trade by the account owner for the whole Business (it can be US$0, shown as “No service call fee”). The fee shown when you showed interest is the fee you agree to charge that homeowner for that visit, and if you marked it “waived if hired,” you agree to waive it if the homeowner hires you for the job. A later change applies only to leads you show interest in afterwards.
  • Tack On doesn’t set or collect your fee and isn’t responsible for it. A homeowner can report a higher charge to our support team; we review reports, and repeated or serious cases lead to suspension under section 12.
  • The start year you enter as “in business since” must be true. Homeowners see it marked as your own statement.

6. Payment and your card

  • Who may save a card. Only the Business owner saves a card, and confirms they are the cardholder or authorized by the cardholder and the Business to agree to these charges. The owner accepts the stored-card terms shown on the card screen before the card is saved; those terms are part of this agreement and we keep a record of the version, time and device.
  • What is charged, and when. You authorize Tack On LLC to charge the saved card the lead fee ($20.00 in total per completed introduction, in US dollars, with any Texas sales and use tax that applies included in that amount) each time a homeowner picks a member of your team who showed interest in a lead (or for whom interest was shown), without any further approval at that moment. Showing interest, saving a card and confirming these terms are never charged. Charges are unscheduled: there is no charge unless a homeowner picks you, and there can be more than one in a day. Owners can limit how many leads each technician is picked for per day and per week. The charge is made the moment the homeowner picks you, and the lead details unlock once it succeeds. While picking is temporarily unavailable (section 4), nothing is charged.
  • Your statement. Charges appear as TACKON* LEAD followed by a short reference.
  • If the charge fails. If the card is declined, has expired, or your bank asks for extra authentication at that moment, nothing is charged, the homeowner is told and can pick someone else, and we ask you to update or re-confirm the card. A failed charge pauses your ability to show interest for about an hour; a second failure within 24 hours pauses it for 24 hours and we review the account. A successful charge, or saving a different card, clears the pause. If no chargeable card is on file when you are picked, nothing is charged and the homeowner picks someone else.
  • Stopping charges. You can stop future charges at any time by removing the card or closing the account in the app. Leads you were already picked for stay charged. If your bank replaces the saved card with a card of a different brand, the owner must confirm the stored-card terms again before the Business can be picked and charged again.
  • Refunds. Refunds are handled under the Lead Refund Policy version that was in effect when the lead was opened, which is shown on the lead. Approved refunds are the full fee, to the card that paid; we don’t issue lead credits.
  • Sales tax and receipts. The lead price is the total we charge. Where Texas sales and use tax applies to the fee, it is included in that price and is not added on top; the receipt then states that Texas state and local sales and use tax is included in the sales price and shows the amount included. We issue a receipt for each charge and each refund (and for a refund that could not be completed), in the app and by email to the Business's owners.
  • Payments are processed by Stripe. We don’t store full card numbers.
  • Card disputes. Please use the Lead Refund Policy and support@tackon.io first; we aim to resolve problems within 2 business days. Nothing here limits your right to dispute a charge with your card issuer. While a dispute on a lead fee is open we pause new lead purchases for your Business, because the same fee can’t be both refunded by us and charged back; a lost dispute ends your exclusivity on that lead, and repeated disputes of fees for leads you used can lead to account review or closure.

7. Exclusivity

We never resell a completed introduction. Once Tack On has successfully charged your Business for a lead and released the homeowner’s protected contact and job details to you, Tack On will not sell or release that same request to any other paying business, including after a refund, a card dispute, or the end of your access. Your access to the homeowner’s details can end under these Pro Terms, the Privacy Policy and the Lead Refund Policy; ending your access does not end this commitment. It concerns Tack On’s sale of that particular request only: the homeowner remains free to contact or hire anyone else, and to send Tack On a new request, which is a new lead. You don’t own the homeowner’s personal information; you may use it only as section 8 allows.

Once you are picked for a lead, no other Business can buy it while your exclusivity lasts. Exclusivity ends at the earliest of: the job being completed or closed without a hire; an approved refund; a card dispute you lose; a decision by our operations team under section 12 or to protect a homeowner (for example after a missed contact deadline or a complaint); 7 days after the pick for urgent and same-day jobs; or the end of the service window plus 3 days for scheduled jobs. When exclusivity ends, your access to the homeowner’s phone number and address ends and the message thread becomes read-only. The request is not offered or sold again after that. Read-only means neither of you can send new messages in that thread. Earlier messages stay readable to you and the homeowner for up to 2 years after the conversation closes, and are then deleted under the Privacy Policy (sooner for a person who closes their account; longer only where the law or an open dispute requires). Anything already written in them, such as a phone number, stays in them until then; section 8’s limits on using homeowner information still apply to it.

8. Contacting the homeowner

  • Make first contact within 5 minutes for urgent jobs, 15 minutes for same-day jobs, or 2 business hours (7 am to 9 pm Central) for scheduled jobs, and establish two-way contact within 30 minutes, 2 hours, or 24 hours before the window respectively. We track these deadlines. Missing them can let us end your exclusivity and counts in reviews of your account. It doesn’t make you eligible for a refund.
  • You receive the homeowner’s first name, phone number, address and access notes as soon as the charge succeeds, with their preference: call first, or message in the app first. Honor it. Message them in the app or call them using the app’s Call button: only in-app messages and calls started from the Call button are logged as contact attempts, and only logged attempts count in a refund review.
  • Use homeowner information only to handle that request, and only while your exclusivity lasts. Don’t add homeowners to marketing lists, sell or share their information, contact them about anything else, or contact them again later without their separate consent. Stop at once, in every channel, when a homeowner tells you to, in any words.
  • Contact homeowners yourself from your own phone. Don’t use autodialers, mass-texting tools, prerecorded or AI voice calls, or ringless voicemail to reach homeowners you got through Tack On. Don’t send marketing or promotions by text. Don’t present yourself as Tack On or imply that Tack On is calling.
  • You are responsible for complying with the laws that apply to your calls and texts, including the Telephone Consumer Protection Act (47 U.S.C. §227) and its rules, and Texas Business & Commerce Code chapters 302, 304 and 305 (including deciding whether your Business needs a Texas telephone-solicitation registration or qualifies for an exemption). Tack On doesn’t make that determination for you. Homeowner complaints about unwanted contact can lead to suspension.

9. How you do the work

  • You are an independent business. You set your own prices, methods and schedule, provide your own tools and staff, and are solely responsible for the work, permits, inspections, warranties, taxes and your workers. Nothing in these Pro Terms creates employment, partnership, agency, joint venture or franchise, and you may use other platforms and work for anyone you choose.
  • Follow all laws that apply to your trade, including the Texas licensing and advertising rules for your trade: show your license number (and, where required, the “regulated by TDLR” or TSBPE notice) on your proposals, invoices, contracts, vehicles and advertising. The cards Tack On shows homeowners are our own description of our checks, not your advertisement, and are not a substitute for those notices.
  • If you sign a contract or sell additional work at the homeowner’s home, you are responsible for any cancellation rights and notices Texas or federal law requires for sales made in a home.
  • Don’t resell, transfer or share leads, send anyone not on your verified roster, or use another business’s license.
  • Don’t misrepresent your licenses, insurance, identity, prices or relationship with Tack On. Don’t claim that Tack On employs, endorses, certifies or recommends you, or that Tack On is your advertiser or representative.
  • You may decline a hazard job if the scene isn’t under control when you arrive. Tell us through the app; it won’t count against you, but the lead fee isn’t refunded for this reason.

10. Insurance

Heating and air conditioning Businesses must keep the general liability insurance we confirmed in force and tell us if it lapses or changes. We may confirm it with your agent or insurer. All Businesses are responsible for carrying the insurance the law requires for their trade and workers. We mention a Business’s insurance to homeowners only when we have confirmed it as described on our What we check page.

11. Data

We handle your Business’s and team members’ information as described in the Privacy Policy. Before a pick, homeowners see the items listed in section 4, never your name or the Business name. After a pick, they see the Business name, the first name and last initial of the person you send, the licenses we checked (type, issuing agency and whose license it is) and when we last checked, and the month the ID was verified. License numbers are not shown to homeowners on these cards. Owners see which technicians received, declined or took each lead; dispatchers see teammates by name only. Homeowner data you receive is covered by section 8.

12. Suspension, appeal and ending the agreement

  • You can close your account at any time in the app or by email; closing doesn’t undo charges for leads you were already picked for, and we keep the records the law and the Privacy Policy require.
  • We may suspend or end the Business’s access or a team member’s access, immediately where needed, if these Pro Terms are broken; if eligibility lapses; for suspected fraud, license misuse, lead transfer, misrepresentation or collusion; for charging more than the service call fee shown; for repeated missed contact deadlines or homeowner complaints, including about unwanted contact; or to protect homeowners or the Service.
  • Where we can, we will tell you the reason and how to respond. You can reply at support@tackon.io within 10 days with anything you want us to consider; a person reviews it and we answer. Leads you already hold stay open during a review unless a homeowner’s physical wellbeing or a legal requirement means otherwise.

13. Disclaimers

THE SERVICE AND LEADS ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND MAKE NO PROMISE ABOUT LEAD VOLUME, HOMEOWNER INTENT, RESPONSE OR OUTCOME BEYOND WHAT THE LEAD REFUND POLICY PROVIDES. What we confirm about homeowners is stated in section 1. Nothing in these Pro Terms limits rights the law doesn’t let you waive, including under the Texas Deceptive Trade Practices Act.

14. Limits on our liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OR LOST PROFITS, AND OUR TOTAL LIABILITY TO THE BUSINESS FOR ALL CLAIMS RELATING TO THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, IS LIMITED TO THE GREATER OF US$100 OR THE LEAD FEES YOU PAID US IN THE 6 MONTHS BEFORE THE CLAIM AROSE. These limits don’t apply to liability that can’t be limited by law, including for our gross negligence, fraud or wilful misconduct.

15. Indemnity

THE BUSINESS WILL DEFEND AND INDEMNIFY TACK ON, ITS OWNERS AND STAFF AGAINST THIRD-PARTY CLAIMS, LOSSES AND COSTS (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING FROM THE BUSINESS’S WORK, ITS WORKERS, ITS CALLS, TEXTS AND OTHER CONTACT WITH HOMEOWNERS, ITS USE OF HOMEOWNER INFORMATION, ITS BREACH OF THESE PRO TERMS OR ITS VIOLATION OF LAW, except to the extent a claim is caused by our own negligence or breach. We will notify you of a claim promptly and may take over its defense at our expense; you won’t settle a claim that admits fault for us without our consent.

16. Changes

When we change these Pro Terms, we publish the new version, with its version name and effective date, at tackon.io/contractor-terms, and the app shows it to you and asks you to accept it before your Business can show interest in another lead. A new version binds the Business only once a person authorized to bind it accepts it in the app; until then you keep your account, your leads and your message threads, but can’t show interest. If the stored-card terms change, the owner must confirm the new terms in the app before any further charge to the saved card; confirming never charges the card. Leads you were picked for before a change stay under the terms in effect when you were picked. Changes never apply to a dispute of which either of us had already given notice, and changes to section 17 follow 17.7.

17. Disputes

This section covers disputes and claims between the Business (including its team members) and Tack On LLC relating to the Service or these Pro Terms (“Disputes”). The Business and Tack On are independent businesses dealing with each other commercially. There is no arbitration requirement. Either side can take a Dispute to court, and nothing in these Pro Terms waives either side’s right to a jury trial or to take part in a class or other group action where the law allows it.

17.1 Talking first is voluntary. Either side may write to the other (to us at support@tackon.io or by mail to Tack On LLC, 1314 W McDermott Dr, Ste 106, PMB 274, Allen, TX 75013; to the Business at the owner’s account email) and suggest negotiating or mediating a Dispute. Mediation happens only if both sides agree, including on how its cost is shared. Neither is required before going to court, and neither changes any deadline unless both sides agree in writing to pause it.

17.2 Courts. A Dispute may be brought in any court that has jurisdiction over it, including a justice court (small claims) for a claim that qualifies. Where the law allows the parties to agree on venue, the state and federal courts located in Collin County, Texas are a proper venue, and both sides accept the jurisdiction of those courts; otherwise venue is where the law provides.

17.3 Governing law. Texas law governs these Pro Terms, without regard to conflict-of-law rules, except where federal law applies or where the law doesn’t allow the parties to choose.

17.4 Urgent relief. Either side may ask a court for a temporary restraining order, an injunction or other urgent relief the law allows, for example to stop misuse of homeowner information, unauthorized access to the Service or infringement of intellectual property.

17.5 Matters the law governs. Disputes about charges and refunds, privacy, the use or misuse of homeowner information and intellectual property remain subject to the laws that apply to them, and this section doesn’t limit any remedy those laws provide. Sections 6 and 7 and the Lead Refund Policy still decide how lead fees, refunds and exclusivity work. Nothing in these Pro Terms limits rights the law doesn’t let either side waive, and either side may report a concern to a government agency.

17.6 The Business’s own customers. The Business’s agreements with homeowners about the work, and disputes under them, are between the Business and the homeowner. Tack On isn’t a party to them, and this section doesn’t govern them.

17.7 Changes to this section apply only once the Business accepts the version that contains them (section 16) and never to a Dispute of which either side had already given notice or that is already in court.

18. General

These Pro Terms, with the documents they incorporate, are the whole agreement between the Business and Tack On about Tack On Pro. If a part is unenforceable, the rest stays in effect. The Business may not transfer this agreement or its account; we may transfer it in a merger, acquisition or sale of assets. Failing to enforce a part isn’t a waiver. Notices to the Business go to the owner’s account email. Sections 6 (charges already made), 8, 11, 13 to 15, 17 and 18 survive the end of the agreement.
